1. Introduction
Welcome to Canora Diamonds Inc. ("Canora Diamonds", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website, online store, and any related services through which we sell fine jewellery, loose diamonds (laboratory-grown), gemstones, and combined jewellery-and-diamond products (collectively, "Products") to customers in Canada, and the United States. These Terms apply to customers purchasing from any country to which we agree to ship. Nothing in these Terms limits any mandatory local consumer protection rights that cannot be excluded under the laws of your primary place of residence.
By placing an order, creating an account, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, you must not use our website or purchase our Products.

2. Eligibility
You must be at least the age of majority in your jurisdiction (province, state, territory, or country of residence) and have legal capacity to enter into a binding contract to purchase Products from us. By using our services, you represent that you meet this requirement and that all information you provide is accurate and complete. We may refuse or cancel an order if we cannot verify your identity, payment authorization, delivery information, or legal capacity.
3. Products and Descriptions
3.1 Product Range
In these Terms, "diamond" or "diamonds" used alone refers to a laboratory-grown (lab-grown) diamond unless clearly stated otherwise. Natural diamonds will be described as “natural diamond.” Simulated or imitation stones, including cubic zirconia or moissanite, are not diamonds and will be identified separately.
We sell:
- Finished fine jewellery (rings, earrings, necklaces, bracelets, and related items);
- Loose natural diamonds;
- Loose laboratory-grown (lab-grown) diamonds;
- Gemstones and coloured stones; and
- Custom and made-to-order jewellery with or without incorporating diamonds and/or gemstones.
3.2 Accuracy of Information
We make every effort to ensure that product descriptions, images, specifications, diamond grading information, metal types, carat weights, dimensions, and pricing on our website are accurate. However:
- Lab-grown diamonds, natural diamonds and gemstones are unique; slight variations in colour, clarity, cut, and appearance may occur compared to images or descriptions.
- Where total carat weight is provided, it refers to the combined combined approximate weight of all stones (gemstone, diamond, natural diamond) in the item, unless otherwise stated.
- Carat weights, gemstone measurements, metal weights, ring dimensions, and product measurements may vary within reasonable jewellery-industry tolerances unless expressly stated otherwise.
- Made-to-order customized jewellery may show minor variations in finish, dimensions, stone placement, and appearance. Such minor variations do not constitute defects where the Product substantially matches the approved design and product description.
- Screen displays may affect how colours and finishes appear.
- Product availability is subject to change without notice based on the stock.
If a Product is materially different from its description, please contact us promptly. Your statutory consumer rights are not affected.
3.3 Diamond and Gemstone Disclosure
All diamonds, natural diamonds, lab-grown diamonds, gemstone, treated stones, enhanced stones, composite stones, and simulants are disclosed in accordance with our Diamond and Jewellery Disclosure Policy, which forms part of these Terms. These Terms are based on applicable laws in your country of purchase, including FTC Jewellery Guides (USA), and Competition Bureau guidance (Canada) consumer protection requirements.
Customers are responsible for reviewing all product descriptions, certificates, stone details, metal details, dimensions, and disclosure notes before placing an order.
3.4 Country of Manufacture
Finished jewellery products are manufactured by our approved partner facilities in India and imported into Canada by Canora Diamonds Inc. unless otherwise stated on the product page. Loose diamonds and gemstones may originate from other countries as disclosed in the product listing and accompanying certification documentation.
3.5 Certificates and Grading
Where a grading report or certificate (e.g., GIA, IGI, GCAL, or equivalent) is referenced, the certificate number and laboratory will be provided where available. These certificates are issued by independent laboratories and represent the opinion of that laboratory at the time of grading. Grading may vary between laboratories or upon re-examination. We are not responsible for differences in grading opinions, provided the Product supplied corresponds to the grading report referenced at purchase.
4. Pricing and Payment
4.1 Currency and Pricing
Prices are displayed in the different currency at checkout (CAD, USD, or EUR) as applicable to your market. All prices are subject to change without notice until an order is confirmed. Currency conversion rates, foreign transaction fees, and bank charges may be applied by your card issuer or payment provider and are not controlled by us.
4.2 Taxes and Duties
Taxes, customs duties, import charges, brokerage fees, and similar charges depend on the destination country, product classification, order value, country of origin, and shipping method. At checkout or in the order confirmation, we will state whether duties and taxes are included in the purchase price or are payable by the customer upon delivery. Unless we expressly state that an order is delivered duties paid, the customer is responsible for customs duties, import taxes, brokerage fees, and other import-related charges imposed by the destination country.
4.3 Payment Methods
We accept payment methods displayed at checkout, which may include major credit and debit cards, Shop Pay, and other approved payment providers. Payment must be received in full before we commence production or dispatch of made-to-order items, unless otherwise agreed in writing.
We may delay, suspend, or cancel an order while payment, fraud, chargeback, identity, address, or sanctions screening is completed.
4.4 Order Acceptance
Your order constitutes an offer to purchase. A binding contract is formed only when we send an order confirmation email. We reserve the right to refuse or cancel any order before acceptance, including due to pricing errors, stock unavailability, suspected fraud, or failure to pass identity or payment verification checks. We may cancel an accepted order and provide a full refund if the Product, diamond, gemstone, or required material becomes unavailable, if there is a material pricing or specification error, or if we cannot lawfully fulfil the order.
4.5 Identity Verification
For high-value orders, fraud prevention, alternate delivery addresses, financing, international shipment or orders for security review, we may request identity verification, additional payment verification, and proof of address. Orders paid through certain third-party payment methods may be required to ship to the billing address for security reasons. Any collected personal information for verification and/or product delivery fulfillment will be handled in accordance with local privacy policy laws.
5. Customized, Bespoke, and Made-to-Order Products
5.1 Production Timelines
Customized, bespoke, and made-to-order jewellery and diamond settings are handcrafted to your specifications. Estimated production and delivery times are provided at checkout or in your order confirmation and are estimates only, not guarantees.
Production and delivery estimates may be affected by supplier availability, gemstone sourcing, manufacturing capacity, quality control, customs clearance, carrier delays, holidays, force majeure events, or customer delay in approving designs or providing information.
5.2 Design Approval
For bespoke orders, you may be required to approve design renderings, diamond selections, or specifications before production begins. Once approved, changes, cancellation, or returns may not be possible and may incur additional charges.
5.3 Non-Cancelable Orders
Customized, engraved, resized-to-order, and specially sourced items may not be cancelable or returnable once production has commenced, except where required by applicable consumer protection law or where the product is defective, misdescribed or does not conform to the agreed specifications. 6. Shipping and Delivery
Delivery terms are set out in our Shipping and Delivery Policy. Risk of loss passes to you upon product delivery to the address specified in your order, subject to mandatory consumer protection laws. High-value orders may require adult signature, identity verification, delivery appointment, insured shipping, or delivery to the billing address only.
7. Returns, Refunds, and Exchanges
Our Returns, Refunds and Exchanges Policy sets out your rights and our procedures. Statutory rights under Canadian provincial consumer protection laws, and US state consumer laws are preserved and are not limited by these Terms where they provide greater protection. Products that are worn, damaged, altered, resized by another jeweller, missing certificates, missing tags, missing packaging, or otherwise not in original condition may be refused or subject to deduction.
8. Warranty
Our Warranty Policy covers manufacturing defects under the terms stated therein. Our Warranty Policy is a voluntary commercial warranty and is separate from any statutory rights you may have under applicable consumer protection laws.
9. Ring Sizing and Alterations
We offer complimentary ring resizing within 60 days of delivery for eligible rings, subject to inspection, design constraints, metal type, stone setting, engraving, availability of material, and whether resizing can be performed without compromising the product. Full eternity bands, certain tension settings, and other designs may not be resizable. Resizing outside the complimentary period may incur a fee. We are not responsible for sizing errors resulting from customer-provided measurements.
10. Intellectual Property
All content on our website —including text, images, logos, designs, product photography, and graphics — is owned by or licensed to Canora Diamonds Inc. and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent. If you submit designs, images, sketches, logos, engravings, or other materials to us for bespoke jewellery, you represent that you have the right to use them and that our use of them to create your Product will not infringe any third-party rights. You are solely responsible for your inputs, which you provide for customizable jewellery.
11. User Accounts
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorised use. We may suspend or terminate accounts used for fraud, abuse, chargeback misuse, scraping, false information, unlawful activity, or breach of these Terms.
12. Prohibited Uses
You agree not to:
- Use our Products or Service for any unlawful purpose;
- Attempt to gain unauthorised access to our systems or data;
- Submit false or misleading order or payment information;
- Resell Products obtained through our website in breach of these Terms or applicable law;
- Use automated systems to scrape content or place orders without our consent.
- Use our Products or services in connection with fraud, money laundering, terrorist financing, sanctions evasion, prohibited exports, prohibited re-exports, or unlawful resale.
- We may refuse, suspend, or cancel any transaction that we believe may violate applicable Terms.
13. Limitation of Liability
To the fullest extent permitted by applicable law:
- To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive damages.
- Our total liability for any claim arising from a Product or these Terms shall not exceed the amount you paid for the relevant Product.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.
14. Indemnification
You agree to indemnify and hold harmless Canora Diamonds Inc., its directors, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of intellectual property rights, these Terms or misuse of our services.
15. Force Majeure
We are not liable for delays or failures in performance resulting from events beyond our reasonable control, including natural disasters, war, terrorism, labour disputes, supply chain disruptions, government actions, pandemics, or failures of carriers or payment processors. This also includes customs delays, import/export restrictions, supplier disruptions, shortages of diamonds, gemstones or metals, manufacturing delays outside our reasonable control, and carrier disruptions.
16. Governing Law and Dispute Resolution
16.1 Canadian Customers
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Disputes shall be subject to the exclusive jurisdiction of the courts of Ontario, except where mandatory consumer protection laws in your province of residence provide otherwise. These Terms do not limit the mandatory consumer protection laws in your province.
16.2 United States Customers
For US customers, these Terms are governed by the laws of the Province of Ontario and applicable federal Canadian law, except that mandatory consumer protection laws of your U.S. state of residence may apply where they cannot be excluded. Any disputes shall be subject to applicable state consumer protect laws that cannot be waived.
17. Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date at the top will reflect the most recent revision. Material changes will be communicated via our website or by email where appropriate. Continued use of our services after changes constitutes acceptance of the revised Terms. Changes will not apply retroactively to orders already accepted, unless required by law or agreed with you.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, Cookie Policy, Shipping and Delivery Policy, Returns, Refunds and Exchanges Policy, Warranty Policy, Diamond and Jewellery Disclosure Policy, any order confirmation and any other policy listed on website, constitute the entire agreement between you and Canora Diamonds Inc. regarding your purchase.
